 June 23, 2009.  A bill in the State Legislature, AB 761,  that would have basically eliminated mobilehome owners' equity in their homes, was defeated yesterday by a margin of three votes.  The many residents that actively encouraged their legislators to defeat this latest attempt to eliminate rent control should be commended for their efforts.  Be aware, the threat will not go away.

 March 5, 2009. The City of Palm Springs voted to co-sponsor AB 566, a new bill being introduced in the State Legislature to modify conversion code 66427.5.  If passed, the revisions would allow cities more control on conversions and would require a majority of residents to approve the conversion.  If the city were to lose on our appeal in the appellate court (see below) and this bill were passed, it is possible by the time a rehearing on the conversion could be held, the city may the power to condition or disapprove the conversion application.

 December 31, 2008. The City of Palm Springs filed an appeal to the judge's decision on the PSVE conversion case.  The appeal was filed in the Fourth District Court of Appeal, Division 2, in Riverside, Case No. E047460.
It is likely the city will follow some of the arguments presented by the County of Sonoma in an appeal of a superior court decision in favor of the the County and park residents, which is being challenged by the park owner in the First District Court of Appeal, Division 2, Case No. A120049.  This case is being closely watched by mobile home communities, the legal community and local government agencies throughout the state, because it would set new conversion requirements favoring residents if the appeal is defeated.  A defeat would also eliminate some of the negative effects of the El Dorado decision and help preserve affordable housing.

 December 20, 2008.  The park owner and residents of the Indian Springs Mobile Home Park in Palm Desert tentatively agree to a settlement of a long-standing battle over rent increases and conversion to condominium ownership. -more-

 October 20, 2008. The lawsuit filed by the owner of the El Dorado MHP in October 2003 claiming damages of $6 million from the City was settled for just under $1 million out of court. Click here to review the settlement and background of the case.

Market Data: The most comparable park to PSVE in location, age, physical characteristics and amenities is El Dorado, particularly since it adjoins PSVE, is about the same vintage with mobile homes similar to those in the PSVE park and has completed the conversion process.

Is affordable housing for seniors on its way out? In November of 2005, the owners of the Palm Springs View Estates (PSVE) mobile home park in the City of Palm Springs formally announced their intention to “…change the ownership from a rental mobile home park to a resident-owned park,” employing the condominium form of ownership.  Read this update on the PSVE park conversion process and how PSVE and other parks may be impacted.
